A Personal Note From Terry Fong

Before I was a plaintiff's lawyer, I was a defense lawyer. I represented insurance companies defending motor vehicle accident cases. I was often skeptical of the plaintiffs' claims, especially those involving whiplash or closed head injuries. I just didn't see how an apparently minor car accident could cause such major damage - until it happened to my own daughter.

When my daughter was a sophomore at Arizona State University, I got the phone call that no parent wants to receive. I learned that my daughter had been struck by another driver, and I rushed to the hospital to see her.

When they wheeled her out in a wheelchair, I was relieved. Other than a headache, sore neck and a sore back, she seemed fine - just a little dazed. I attributed this to the stress of the accident, but that wasn't the case.

As weeks went by, my daughter wasn't the same person that she was before the accident. It became clear that her emotional and physical health had been greatly affected. She could not perform simple things like reading a newspaper or magazine and reading her textbooks was out of the question; she could not understand what she was reading and felt "stupid;" she was constantly angry, moody, irritable and lashed out verbally at those close to her (prior to the accident, my daughter was a bubbly, happy young woman); she cried a lot and slept most of the time; she dropped out of ASU and stopped socializing with her friends. Finally, a neurologist diagnosed her with a closed head injury, and we learned that her symptoms were classic for those who had suffered a closed head trauma. With that diagnosis, we were finally able to get her appropriate medical treatment. It took almost a year before she was rehabilitated back to preaccident condition.

Our story has a happy ending. My daughter was able to return to school and to her normal life and has now graduated from ASU I know that it could have been worse, and I am grateful that we didn't lose her or her sparkling personality to a brain injury.
